A. Determination has been made based upon an engineering and traffic investigation that the speed limits permitted by State law and by Section 33 of the "Standard Traffic Ordinance for Kansas Cities" as incorporated in Section 300.010 are greater or less than is reasonable or safe under the conditions found to exist upon the following streets designated in Schedule I. The speed limits established in Schedule I have been determined upon the basis of the investigation as being reasonable and safe speed limits thereon. Speed limits so declared shall be effective when appropriate signs giving notice thereof are erected upon such streets and/or parts of streets.
B. All residential streets not otherwise designated in Schedule I shall have a speed limit of twenty-five (25) miles per hour.
C. All streets not otherwise designated in Section 310.010(A) and Section 310.010(B) above shall have speed limits as permitted by State law and by Section 33 of the Standard Traffic Ordinance for Kansas Cities as incorporated in Section 300.010. No person shall operate or halt any vehicle in such a manner as to indicate a careless or heedless disregard for the right or safety of others or in such a manner as to endanger any person or property. (Ord. No. 919 §1, 9-13-95; CC 2000 §14-105)
A. It shall be unlawful for any person to operate a motor vehicle within this City when such person's ability to operate a motor vehicle safely has been impaired by the use of alcoholic liquor or cereal malt beverage as defined in Section 600.010 of this Code.
B. It shall be prima facie evidence that ability is impaired when a breath sample or blood alcohol test reveals a blood alcohol content of at least five-hundredths of one percent (.05%) but less than eight-hundredths of one percent (.08%). SECTION 300.010: INCORPORATING STANDARD TRAFFIC ORDINANCEThere is hereby incorporated by reference for the purpose of regulating traffic within the corporate limits of the City of Mission, Kansas, that a certain "Standard Traffic Ordinance for Kansas Cities", Edition of 2010, prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas, save and except such Articles, Sections, parts or portions as are hereby omitted, deleted, modified or changed. No fewer than three (3) copies of the Standard Traffic Ordinance shall be marked or stamped "Official Copy as Incorporated by the Code of the City of Mission" with all Sections or portions thereof intended to be omitted or changed clearly marked to show any such omissions or change and to which shall be attached a copy of this Chapter and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours. The Police Department, Municipal Court Clerk and all administrative departments of the City charged with enforcement of the ordinance shall be supplied at the cost of the City such number of official copies of such Standard Traffic Ordinance similarly marked as may be deemed expedient. No. 1279 §1, 10-15-08; Ord. No. 1302 §1, 9-16-09; Ord. No. 1328 §1, 8-18-10) SECTION 300.020: TRAFFIC INFRACTIONS AND TRAFFIC OFFENSESA. An ordinance traffic infraction is a violation of any Section of this Chapter that prescribes or requires the same behavior as that prescribed or required by a statutory provision that is classified as a traffic infraction in K.S.A. 8-2118. B. All traffic violations which are included within this Chapter and which are not ordinance traffic infractions, as defined in Subsection (A) of this Section, shall be considered traffic offenses. No. 919 §1, 9-13-95; CC 2000 §14-102) SECTION 300.030: PENALTY FOR SCHEDULED FINESThe fine for violation of an ordinance traffic infraction or any other traffic offense for which the Municipal Judge establishes a fine in a fine schedule shall not be less than ten dollars ($10.00) nor more than five hundred dollars ($500.00). A person tried and convicted for violation of an ordinance infraction or other traffic offense for which a fine has been established in a schedule of fines shall pay a fine fixed by the court not to exceed five hundred dollars ($500.00).
